Baltimore City Court Upholds Padlock Order on City Bar

Bealefeld stresses zero-tolerance for criminal activity in local businesses

BALTIMORE, MD / January 8, 2009 – On January 7th 2009, Baltimore City Circuit Court Judge Lynn K. Stewart upheld the decision of Police Commissioner Frederick Bealefeld to padlock the premises of the Linden Bar and Liquor, Inc located at 904 W. North Avenue in Baltimore.

“The court’s decision reaffirms our zero-tolerance approach to criminal activity and sends a clear message to business owners that you wont be in Baltimore for very long if you’re going to let criminals use your business to sell drugs and engage in violence, said Police Commissioner Frederick Bealefeld.

On August 18, 2008, the Commissioner issued written findings that the premises constituted a public nuisance. In his findings the Commissioner stated that "the record describes a sustained pattern of criminal activity at the location and includes evidence of the business practices of the establishment, and its resistance to the clear need for public safety measures."  Further, he stated, "The overall public safety implications of continuing to a business to become a 'safe haven' for the criminal element are monumental."

The specific incidents presented at the hearing and in the written findings substantiated drug dealing from within the business and a robbery and homicide occurring in July 2008.  The business has remained closed since August 18, 2008.
